In this paper we analyse the legislative precedents of the 1903 Decree, the sanitary conditions in which it had been developing, his gestation process and his passing, and we show an approach to its subsequent implementation. We show how the political-economic-social, legislative, professional and sanitary factors would be determine the slowly generalization of the smallpox vaccination in Spain during the 19th and 20th centuries.
